These Subscription Terms and Conditions ("Subscription Terms"), effective from July 17, 2026, govern subscriptions for prescription products ("Subscription Services") that are offered through the platform, including our website and mobile application ("Platform") that is owned or licensed by Hims & Hers Canada, Inc. ("H&H Canada"). In these Subscription Terms, the terms:
PLEASE READ THESE SUBSCRIPTION TERMS CAREFULLY BECAUSE THEY SET FORTH THE IMPORTANT TERMS YOU WILL NEED TO KNOW ABOUT THE SUBSCRIPTION SERVICES. YOU UNDERSTAND THAT BY ACCESSING OR USING THE SUBSCRIPTION SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY AND COMPLY WITH THE SUBSCRIPTION TERMS IN EFFECT ON THE DATE OF YOUR VISIT. IF YOU DO NOT OR CANNOT AGREE WITH ANY PART OF THESE SUBSCRIPTION TERMS, YOU MAY NOT USE THE SUBSCRIPTION SERVICES AND MUST DISCONTINUE ANY USE OF THE SUBSCRIPTION SERVICES IMMEDIATELY.
Your access to and use of the Subscription Services is subject to these Subscription Terms, our general Terms and Conditions of Use ("General Terms"), as well as all applicable laws and regulations. These Subscription Terms apply together with (and not in substitution of) the General Terms.
In using certain parts of the Subscription Services, you may be presented with additional or supplementary terms regarding the use of those specific services, which you must consent to in order to receive such services. Unless explicitly provided in the additional or supplementary terms, such additional or supplementary terms will apply together with (and not in substitution) of these Subscription Terms.
Unless required by applicable laws, these Subscription Terms are subject to change at our sole discretion and your continued use of the Subscription Services will constitute an affirmative and express acceptance of any such changes. If you disagree with the changes, you may proceed to terminate your use of the Subscription Services in accordance with these Subscription Terms.
If you are an Alberta or Québec consumer:
In providing the Subscription Services, we will handle your personal and health information as described in our Privacy Policy.
Certain services and products provided by Canadian accredited pharmacies with whom we have partnered located in Ontario and British Columbia ("Hims & Hers Pharmacy Partners") and that are advertised through the Platform, may be purchased on an automatically renewing subscription basis (i.e., through the Subscription Services). This means that each new subscription period, whether it be 1 month, 3 months, or any other subscription period specified (in each case, the "Subscription Term"), will be a new contract for which you agree to pay the applicable subscription fee presented to you during the order process and at checkout ("Subscription Fees"). Any changes to fees or payment terms applying to the Subscription Services will be effective upon publication on our website or in our mobile application, or as otherwise provided in a notice to you. Such changes in fees will be effective upon your next Subscription Term. We will notify BC and Québec consumers in writing 30 days before any such changes take effect.
Note that Hims & Hers Canada Inc. is not a pharmacy and is not providing any pharmacy services, but instead, connects users with Hims & Hers Pharmacy Partners that dispense, sell and deliver prescription drugs and provide pharmacy services that form part of the Subscription Services. If Hims & Hers Canada Inc. collects or processes any Subscription Fees (or otherwise in respect of any prescription drugs), it does solely in its capacity as agent for the Hims & Hers Pharmacy Partner.
So long as you are receiving the Subscription Services in respect of a prescription, you agree that we may charge you the applicable Subscription Fee by billing the payment method that you shared with us at checkout on the interval described at checkout.
In order to ensure the continuity of your treatment, the prescription that is the subject of the Subscription Services will be automatically refilled and shipped by a Hims & Hers Pharmacy Partner 5 days in advance of the next Subscription Term (the "Processing Date"), unless you cancel at least 2 days before the next Processing Date (the "Cancellation / Pause Deadline"). On occasion, the Cancellation / Pause Deadline may be 2 days earlier to accommodate holidays or other operational reasons to support treatment continuity. Your next Processing Date can be found in the profile as your "next refill date" or by contacting customer support at support@hims.ca or (514) 700-6933.
We will send you a notice by email to the email address in your profile in advance of the Cancellation / Pause Deadline and provide you the opportunity to pause or cancel the Subscription Services before the subscription is renewed for a new Subscription Term. You can pause or cancel your subscription as described below under the heading "Cancellations and refunds" in your patient portal. If you do not pause or cancel your subscription prior to the Cancellation / Pause Deadline, your subscription will automatically renew, and you will be charged the applicable Subscription Fees.
Cancellations made prior to the Cancellation / Pause Deadline will take effect at the end of the current Subscription Term, meaning if you cancel your subscription during a Subscription Term but prior to the Cancellation / Pause Deadline, it will remain active until the end of your current Subscription Term that you have paid for. If you do not cancel your subscription before the Cancellation / Pause Deadline, your subscription will automatically renew for another Subscription Term.
Refunds are only available at our sole discretion. We do not offer refunds for partially used medications delivered during a Subscription Term. If a medication is unavailable due to supply or you are deemed unsuitable for treatment, we may cancel your prescription and/or the Subscription Services more generally. Once your order and subscription has been processed by our Hims & Hers Pharmacy Partner, the sale is final and cannot be canceled.
